HireGenics’ philosophy focuses on achieving and monitoring all aspects of compliance for the duration of the IC engagement lifecycle.
Based upon the results of the initial assessment, a risk profile is generated qualifying the IC into one of four categories: probably qualified, absolutely qualified, probably not qualified, and absolutely not qualified. The compliance team then works with the IC and the engagement manager, as necessary, and based on the amount of risk, brings the IC into compliance with applicable law. HireGenics works with the individual (and the engagement manager, as necessary) through the entire process to ensure compliance, to educate, and to prevent future noncompliance. If necessary, HireGenics will convert ICs with unacceptable risk levels to a W-2 payrollee but only pursues this option as a last resort. This entire, hands-on process, which is augmented by technology, has proven to be the best way to ensure contractor compliance, retention and satisfaction.
Absolutely Qualified
- Possess all of the documentation to verify qualification.
- Possess the desire and willingness to maintain the required tasks to remain qualified.
Action: Engage and manage under the terms of a MSA. Store all compliance documents in HGComply. Age and replace each document before expiration.
Absolutely not Qualified
- Do not possess any of the documentation to verify qualification.
- Do not possess the desire and willingness to perform the
required tasks to become qualified.
Action: Align this population of workers as W-2 payrolled employees of an “Employer of Record.” Gather, store and manage all compliance documentation to assure absolute positive audit results.
Probably Qualified
- Possess some of the documentation to verify qualification.
- Possess the desire and willingness to perform the required tasks to become qualified.
Action: Mentor this population of workers and provide services to each such that they fully meet the requirements. Certify as “Absolutely Qualified.”
Probably not Qualified
- Possess some of the documentation to verify qualification.
- Do not possess the desire and willingness to perform the
required tasks to become qualified.
Action: Offer mentoring to those willing to perform the tasks
required to fully meet the standard. Those who fail to meet the standard, align this population of workers as W-2 payrolled employees of an “Employer of Record.”
